The Visa for Australian to Work in USA, or E-3, is a type of visa available only to nationals of Australia who are coming to the U.S. in order to perform services in a specialty occupation. While only available for Australian nationals, in other respects the E-3 visa program is similar to the H-1B visa program inasmuch as the applicant must be seeking to fill a specialty occupation position that involves theoretical and practical knowledge in a professional field and at least the attainment of a bachelor’s degree or its equivalent, as a minimum for entry into the relevant occupation.
The E-3 visa is renewable indefinitely (in two-year increments) and the application process is considerably streamlined. Australian citizens applying for an E-3 visa are not subject to the 65,000 annual visa limit for H-1B visas; although there is a separate annual quota of 10,500 E-3 visas, this more favorable to Australian nationals than requiring them to compete with citizens of all other nations for H-1B visas. Visas issued to spouses and children are not included in the E3 quota and spouses and children do not need to be Australian citizens.
